California Break Rules

JoinedUp now supports the ability to comply with California legislation within shift templates.

Please contact your Customer Operations Specialist to enable this feature.

The current California state meal break rules are:

  • Non-exempt workers are entitled to a 30-minute uninterrupted, duty-free meal break if more than 5 hours are worked in a workday.

  • They are also entitled to a 10-minute uninterrupted, duty-free rest break for every 4 hours worked (or “major fraction” thereof).

  • If these are not complied with, then one extra hour of regular pay for each day a meal break violation occurred on is mandated, and another extra hour of regular pay for each day on which a rest break violation occurred.

When enabled, the feature allows workers to confirm whether they took legislative breaks after their shift has ended.

To view this within shift templates, navigate to the Advanced settings and scroll down to Time and Attendance settings.

Set Allow worker to enter attendance via JoinedUp on-site tablet app to Yes, and more fields will appear.

Now, set the field Set attestation notice for workers to confirm whether they have taken legislative breaks to Yes.

Make sure to save your changes.

By setting Prevent clock-out of breaks under 30 minutes to Yes, ensures that workers will not be able to clock out before their 30-minute break, regardless of the length of the shift.

This will appear on the T&A tablet.

When the worker clocks out on the T&A app, then the attestation modal will appear for the worker.

The worker can then select Yes, Yes - waivered, or No.

If the Confirm button is not clicked within 5 seconds, a 10-second countdown will begin. If no selection is made before the timer expires, the system will record 'No response'.

Reporting No for an allocated break will result in a penalty for every missed instance.

Penalities

If a worker reports a missed break, a penalty must be applied via a manual or historic adjustment.

For each missed rest or meal break, the worker is entitled to one additional hour of pay at their normal rate. These penalties are capped at a maximum of two hours of extra pay per shift.

To manage this, end-hirers can access the End-Hirer – Breaks Detail custom report. This report provides a comprehensive view of all shift details within a selected timeframe, including essential information regarding meal breaks.

To enable this custom report, please contact your Customer Operations Specialist.

In the AC column of the csv file, you will see the responses recorded by workers when asked to confirm that they took their allocated breaks.

You can filter for all workers who reported No.

If a worker reported No, you will need to go and add a manual or historic adjustment for this worker for this shift.

To apply an adjustment, navigate to the Shift Details page. Click Add an Adjustment and select either Meal Break Premium or Rest Break Premium.

You can also add adjustments in the Finance tab, Timesheets screen.

You can adjust the value by changing the adjustment length instead of a lump sum.
